Planning Conditions

The set of conditions that Barratt Homes must satisfy in relation to Southwark Council's granting of planning permission during the Planning Committee Meeting on 4 November 2008.  

Some of the conditions are standard to many planning consents, others are more specific.

Condition 41 is the health/community centre revised application.

Paul Noblet believes that conditions 8, 29, 37, 39 and 40 should also have a particularly close eye kept on them.

1) The development hereby permitted shall be begun before the end of three years from the date of this permission.
Reason
As required by Section 91 of the Town and Country Planning Act 1990 as amended.
 
2) Prior to commencement of development on the site a palette of all external materials to be used in the carrying out of this permission shall be submitted to and approved in writing by the Local Planning Authority. Samples of all external materials to be used for each relevant block shall be submitted to and approved by the Local Planning Authority before any work to the relevant block is carried out. The development shall not be carried out otherwise than in accordance with any such approval given.
Reason
In order that the Local Planning Authority may be satisfied as to the details of the external materials in the interest of the appearance of the development, in accordance with policies 3.12 and 3.13 of the Southwark Plan 2007.

3) The dwellings hereby permitted shall not be occupied before details of the arrangements for the storing of domestic refuse for the relevant blocks have been submitted to and approved in writing by the Local Planning Authority and the facilities approved have been provided and are available for use by the occupiers of the dwellings. The facilities shall thereafter be retained for refuse storage and the space used for no other purpose without the prior written consent of the Council as Local Planning Authority.
Reason
In order that the Council may be satisfied that suitable facilities for the storage of refuse will be provided and retained in the interest of protecting the amenity of the site and the area in general from litter, odour and potential vermin/pest nuisance in accordance with policies 3.2 and 3.8 of the Southwark Plan 2007.

4) The health centre and community centre uses hereby permitted shall not be commenced before details of the arrangements for the storing of refuse have been submitted to and approved in writing by the Local Planning Authority and the facilities approved have been provided and are available for use by the occupiers and users of the premises. The facilities shall thereafter be retained for refuse storage and the space used for no other purpose without the prior written consent of the Council as Local Planning Authority.
Reason
In order that the Council may be satisfied that suitable facilities for the storage of refuse will be provided and retained in the interest of protecting the amenity of the site and the area in general from litter, odour and potential vermin/pest nuisance in accordance with policies 3.2 and 3.8 of the Southwark Plan 2007.

5) Details of the facilities to be provided for the storage of bicycles shall be submitted to and approved in writing by the Local Planning Authority before any work in connection with this permission is carried out and the premises shall not be occupied until any such facilities as may have been approved have been provided. Thereafter the cycle parking facilities provided shall be retained and the space used for no other purpose without the prior written consent of the Local Planning Authority.
Reason
In order to ensure that satisfactory safe and secure cycle parking facilities are provided and retained in order to encourage the use of cycling as an alternative means of transport to the development and to reduce reliance on the use of the private car in accordance with policy 5.3 of the Southwark Plan 2007.

6) Detailed drawings of a landscaping scheme, including provision for the planting of suitable trees and shrubs, showing the treatment of all parts of the site not covered by buildings (including surfacing materials of any parking, access, or pathways and green walls) and where the existing compass fountain adjoining the Redriff Primary School entrance will be re-located shall be submitted to and approved in writing by the Council before the development hereby permitted is begun and the landscaping scheme approved shall thereafter be carried out in the first appropriate planting season following completion of the building works.
Reason
So that the Council may be satisfied with the details and visual appearance of the landscaping scheme as required by policies 3.2 and 3.13 of the Southwark Plan 2007.

7) Any tree or shrub required to be retained or to be planted as part of a landscaping scheme approved, either as part of this decision or arising from a condition imposed as part of this decision, that is found to be dead, dying, severely damaged or seriously diseased within five years of the completion of the development, shall be replaced by specimens of similar or appropriate size and species in the first suitable planting season.
Reason
In order that the Council may be satisfied with the details and visual appearance of the landscaping scheme as required by policies 3.2 and 3.13 of the Southwark Plan 2007.

8) Details of the means by which the existing trees on the site are to be protected from damage by vehicles, stored or stacked building supplies, waste or other materials, and building plant or other equipment shall be submitted to and approved in writing by the Local Planning Authority before any work is begun, and such protection shall be installed and retained throughout the period of the works.
Reason
So that the Council may be satisfied that appropriate tree protection measures will be provided throughout the period of development works in accordance with policies 3.2 and 3.13 of the Southwark Plan 2007.

9) Details (to include details of trial holes or trenches to check the position of roots) of foundation works to be used in the construction of this development showing how the roots of the tree(s) will be protected shall be submitted to and approved in writing by the Local Planning Authority before any work is begun, and such protection shall be installed and retained throughout the period of the works.
Reasons
To ensure that the detailed proposals for tree protection measures will achieve the satisfactory protection of retained trees on the site, in accordance with policies 3.2 and 3.13 of the Southwark Plan 2007.
 
10) Details of any external lighting [including design, power and position of luminaires] and CCTV security surveillance equipment of external areas surrounding the buildings shall be submitted to and approved in writing by the Local Planning Authority before any such lighting or security equipment is installed and the development shall thereafter not be carried out otherwise than in accordance with any approval given.
Reason
In order that the Council may be satisfied as to the details of the development in the interest of the visual amenity of the area, the safety and security of persons using the area and the amenity and privacy of adjoining occupiers in accordance with Policies 3.2 and 3.14 of the Southwark Plan 2007.

11) Details of a survey and investigation of the soil conditions of the site, sufficient to identify the nature and extent of any soil contamination, together with a schedule of the methods by which it is proposed to neutralise, seal, or remove the contaminating substances, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of works. All approved measures shall be carried out before any part of the development is occupied and a report certifying such completion shall have been submitted to the Local Planning Authority prior to such occupation.
Reason
In order to protect construction employees and future occupiers of the site from potential health-threatening substances in the soil, in accordance with policy 3.2 of the Southwark Plan 2007.

12) Surface water source control measures shall be carried out in accordance with details which shall be submitted to and approved in writing by the Local Planning Authority before development commences
Reason:
In order to avoid surface flooding and ground water contamination in accordance with PPS 25: Development and Flood Risk.
 
13) Prior to the commencement of development a detailed site survey showing the finished ground levels of the proposed buildings in relation to existing ground levels and roads shall be submitted to and approved in writing by the Local Planning Authority. The proposed buildings shall be built in accordance with the approved ground levels.
Reason:
So that the Council may be satisfied with the details of the development and the ground levels and building heights, in accordance with policies 3.2 and 3.13 of the Southwark Plan 2007.

14) The development hereby permitted shall not be commenced until the applicant has submitted to the Local Planning Authority for approval in writing a detailed energy demand assessment and report identifying how a minimum of 14.1% of the development's total carbon dioxide emissions are off-set by on-site low or zero carbon energy technologies. The approved scheme shall then be provided in accordance with these details prior to the first occupation of the development and thereafter retained and used for energy supply for so long as the development remains in existence.
Reason
To ensure the development complies with policies 3.4 and 3.5 of the Southwark Plan and policies 4A.6 and 4A.7 of the London Plan 2008.

15) Details of the safety and security measures, including CCTV and lighting, to be provided in the undercroft car parking areas shall be submitted to and approved in writing by the Local Planning Authority before the development hereby approved is commenced and the premises shall not be occupied until such measures as may have been approved have been provided. Thereafter the safety and security measures provided shall be retained unless otherwise approved in writing by the local planning authority.
Reason
So the Council may be satisfied with the safety and security of the proposed development, in accordance with policy 3.14 of the Southwark Plan 2007.

16) Prior to the commencement of the development, details of any floor below the 1 in 200 year plus climate change level along with an evacuation plan covering flood evacuation and escape routes, in house warning system, signage within and outside the affected buildings below this level, shall be submitted to and approved in writing by the Local Planning Authority. The approved works and the evacuation plan will then be implemented in full from the date the building is occupied.
Reason
To minimise the risk to users of the development from flooding in accordance with PPS 25 - Development and Flood Risk.

17) The disabled person car parking spaces shall be designed to provide a minimum 1.2m clear space along each side and 1.2m wide safety zone at each end to provide boot access or for use of a rear hoist
Reason
To ensure the development is accessible in accordance with policy 5.7 of the Southwark Plan 2007.

18) Prior to the commencement of development details of the proposed boundary treatments to the development and within the development shall be submitted to and approved in writing by the Local Planning Authority. The development shall not be completed other than in accordance with the details so approved.
Reason
To ensure that the development is properly secure in accordance with policy 4.2 of the Southwark Plan 2007

19) Prior to the commencement of development, a drainage strategy detailing any on and or off site drainage works shall be submitted to and approved in writing by the Local Planning Authority in consultation with Thames Water. No discharge of foul or surface water from the site shall be accepted into the public systems until drainage works referred to in the strategy have been completed.
Reason
The development may lead to sewage flooding and to ensure that sufficient capacity is made available to cope with the new development and in order to avoid adverse environmental impact upon the community in accordance with policies 3.1 and 3.2 of the Southwark Plan 2007.

20) Prior to the commencement of development, an impact study of the existing water supply infrastructure shall be submitted to and approved in writing by the Local Planning Authority (in consultation with Thames Water). The study should determine the magnitude of any new additional capacity required in the system and a suitable connection point.
Reason
To ensure that the water supply infrastructure has sufficient capacity to cope with the additional demand in accordance with policy 3.1 of the Southwark Plan 2007.

21) Not withstanding the provisions of Parts 24 and 25 The Town & Country Planning [General Permitted Development] Order 1995 [as amended or re-enacted] no external telecommunications equipment or structures shall be placed on the roof or any other part of a building hereby permitted without the prior written consent of the Local Planning Authority.
Reason
In order to ensure that no telecommunications plant or equipment which might be detrimental to the design and appearance of the building and visual amenity of the area is installed on the roof of the building in accordance with policies 3.11 and 3.13 of the Southwark Plan 2007.

22) Deliveries, unloading and loading to all non-residential uses hereby approved shall only be between the following hours: 08:00 to 20:00 - Monday to Saturday, Sundays/ Bank Holidays - not at all.
Reason
To ensure that and occupiers of the development and occupiers of neighbouring premises do not suffer a loss of amenity by reason of noise nuisance in accordance policy 3.2 of the Southwark Plan 2007.

23) All dwellings hereby approved are to be designed to Lifetime Homes standards and ten percent of the housing shall be wheelchair accessible.
Reason
To ensure inclusive design in accordance with policies 4.2 and 4.3 of the Southwark Plan 2007.

24) The ecological buffer zone between Block A/B and the western boundary hereby approved shall be accessible to all residents within the development hereby approved.
Reason
To provide adequate amenity space to all residents within the development in accordance with policies 3.12, 3.13 and 4.2 of the Southwark Plan 2007.

25) Prior to the completion of development on site, details of screening between the east and north facing balconies on Block A/B shall be submitted to and approved in writing by the Local Planning Authority and the development shall not be carried out otherwise than in accordance with any such approval given.
Reason
In order to restrict overlooking and protect the amenity of future residents of the building in accordance with policies 3.2, 3.12, 3.13 and 4.2 of the Southwark Plan 2007.

26) Prior to the commencement of development details of a Sustainable Urban Drainage System (SUDS) for the development shall be submitted to and approved in writing by the Local Planning Authority. The SUDS shall then be implemented as approved.
Reason
To encourage sustainable drainage from the site in accordance with policy 3.1 of the Southwark Plan 2007.

27) All residential premises shall be designed in accordance with BS8233:1999 'Sound insulation and noise reduction for buildings-Code of Practice' to attain the following internal noise levels:
Bedrooms- 35dB LAeq, T* and 45dB LA max
Living rooms- 40dB LAeq, T*
A test shall be carried out after completion but prior to occupation to show that the criteria above have been met and the results submitted to the Local Planning Authority for approval.
*T- Night-time 8 hours between 23:00-07:00 and daytime 16 hours between 07:00-23:00.
Reason
To ensure that the occupiers and users of the proposed development do not suffer a loss of amenity by reason of excess noise from environmental and transportation sources in accordance with policy 3.2 of the Southwark Plan 2007 and PPG 24: Planning and Noise.

28) The rated noise level from any plant, together with any associated ducting, shall be 10 dB(A) or more below the measured LA90 level at the nearest noise sensitive premises ¿ a positive indication that complaints are unlikely. The method of assessment shall be carried in accordance with BS4142:1997 'Rating industrial noise affecting mixed residential and industrial areas'. The equipment shall be installed and constructed in accordance with any approved scheme and be permanently maintained thereafter.
Within one month of the installation of the plant and equipment, you are required to submit a further noise report confirming previous details and subsequent measurement data of the installed plant to demonstrate compliance with the above requirements. The supplementary acoustic report must include:
A schedule of all plant and equipment installed;
Locations of the plant and machinery and associated: ducting; attenuation and damping equipment;
Manufacturer specifications of sound emissions in octave or third octave detail;
The location of all most affected noise sensitive receptor locations and the most affected windows;
Distances between plant & equipment and receptor location/s and any mitigating features that may attenuate the sound level received at the most affected receptor location;
The lowest existing LA90, T measurement as already established.
New noise monitoring data, measurement evidence and any calculations demonstrating that plant complies with the planning condition.
Reason
To ensure that occupiers of neighbouring premises do not suffer a loss of amenity by reason of noise nuisance from plant and machinery in accordance with policy 3.2 of the Southwark Plan 2007 and PPG24- Planning and Noise.
 
29) The development shall not commence until details of a Construction Management Strategy has been submitted to, and approved in writing by the Local Planning Authority for that part of the development. The Management Scheme and Code of Practice shall oblige the applicant, or developer and its contractor to use all best endeavours to minimise disturbances including but not limited to noise, vibration, dust, smoke and plant emissions emanating from the site and will include the following information for agreement:
A detailed specification of demolition and construction works at each phase of development including consideration of environmental impacts and the required remedial measures.
The specification shall include details of the method of piling.
Engineering measures, acoustic screening and the provision of sound insulation required mitigating or eliminating specific environmental impacts.
Arrangements for publicity and promotion of the scheme during construction.
A commitment to adopt and implement of the ICE Demolition Protocol and Considerate Contractor Scheme registration.
Details of construction traffic minimisation measures on the local highway network.
All demolition and construction work shall be undertaken in strict accordance with the approved management scheme and code of practice, unless otherwise agreed in writing by the Local Planning Authority.
Reason
To ensure that and occupiers of neighbouring premises do not suffer a loss of amenity by reason of pollution and nuisance in accordance with policy 3.2 of The Southwark Plan 2007.
 
30) Prior to the commencement of development on site, details of proposed works and foundation arrangements shall be submitted to and approved in writing by the Local Planning Authority (in consultation with London Underground) and the development shall not be carried out otherwise than in accordance with any such approval given.
Reason
In order to safeguard London Underground property in accordance with policy 5.2 of the Southwark Plan 2007.
 
31) Prior to the commencement of development on site, details of the removal of the Japanese knotweed within the site shall be submitted to and approved in writing by the Local Planning Authority and the development shall not be carried out otherwise than in accordance with any such approval given.Reason
In order to protect the site and the surrounding are from this noxious weed in accordance with policy 3.1 of the Southwark Plan 2007.
 
32) Surface water management measures shall be carried out in accordance with the accepted micro-drainage calculations and the subsurface urban drainage systems, as detailed in layout number 44702403 dated September 2008.
Reason
To ensure that the development is designed safely in respect of flood risk in accordance with PPS 25: Development and Flood Risk.
 
33) Within 6 months of the occupation of 50% of the development a revised School Travel Plan for Redriff Primary School shall be submitted to and approved in writing by the Local Planning Authority.
Reason
In order that the use of non-car based travel is encouraged in accordance with Strategic Policy SP18 Sustainable Transport and policies 5.2 and 5.3 of the Southwark Plan 2007.

34) The opaque glazing to the north elevation of Block H as indicated on elevation plan number PL 022 Revision D, shall be installed and maintained throughout the life of the development.
Reason
In order to prevent overlooking between habitable rooms in accordance with policy 4.2 of the Southwark Plan 2007.

35) Notwithstanding the details already submitted, details of the car parking and servicing spaces providing for the residential units, community centre and health centre, including disabled bays, 3 car club bays and details of associated manoeuvring areas and the arrangements for allocating the parking spaces, shall be submitted to and approved in writing by the Local Planning Authority before the development is begun and the development shall not be carried out otherwise than in accordance with any approval given. These spaces and areas once approved shall be provided and maintained and not used for any other purpose.
Reason
In order for the Council to be satisfied with the details of the parking arrangements in accordance with policies 5.6 and 5.7 of the Southwark Plan 2007.
 
36) Prior to works commencing on site a further bat survey shall be undertaken and shall be submitted to and approved in writing by the Local Planning Authority.
Reason
In order to confirm whether there is a presence of bats on site before development commences in accordance with policy 3.28 of the Southwark Plan 2007.

37) Prior to works commencing on site, details of the installation of bat boxes and bat bricks shall be submitted to and approved in writing by the Local Planning Authority.
Reason
In order to protect the biodiversity of the area in accordance with policy 3.28 of the Southwark Plan 2007.

38) Prior to commencement of the development hereby approved, details of the installation (including location and type) of at least twenty electric vehicle charger points within the car parking area must be submitted to and approved in writing by the Local Planning Authority. The electric vehicle charger points shall be installed prior to occupation of the development and retained for the lifetime of the building.
Reason
To encourage sustainable travel in accordance with London Plan Policy 4A.2 and policies 3.1, 3.3 and 5.2 of the Southwark Plan 2007.

39) Piling or any other foundation designs using penetrative methods will not be permitted other than with the express written consent of the Local Planning Authority, which may be given for those parts of the site where it has been demonstrated that there is no resultant unacceptable risk to groundwater.
Reason
To protect groundwater quality in the Thanet Sands in accordance with PPS 23 - Planning and Pollution Control.

40) No infiltration of surface water drainage into the ground is permitted other than with the express written consent of the Local Planning Authority, which may be given for those parts of the site where it has been demonstrated that there is no resultant unacceptable risk to controlled waters.
Reason
To protect groundwater quality - there is an increased potential for groundwater pollution from inappropriately located infiltration systems such as soakaways, unsealed porous pavements or infiltration basins in accordance with PPS 23 - Planning and Pollution Control.
 
41) Notwithstanding the plans hereby approved no development shall take place on Block E and no demolition of the existing health centre on site shall take place until a scheme for the internal layout of the health centre and the community centre has been submitted to and approved in writing by the Local Planning Authority. The scheme shall demonstrate that the community centre has been increased and is of a size capable of operating as a viable community centre subject to:
the operational and financial viability of the health centre;
the deliverability of the development as a whole.
Block E shall be built in accordance with the plans approved.
Reason
To ensure that the development provides a community centre of a suitable size that caters to a wide range of potential uses by the local community in accordance with policy 2.2, site specific policy 7P and strategic policy SP 9 of the Southwark Plan 2007.

42) Before any work in connection with this permission is carried out to the health facility and community room building, the applicant shall provide to the Local Planning Authority an independently verified BREEAM report (detailing performance in each category, overall score, BREEAM rating and a BREEAM certificate of building performance) to achieve a minimum 'Very Good' rating. The approved scheme shall then be provided in accordance with these details and a certified Post Construction Review (or other verification process agreed with the local planning authority) shall be provided, confirming that the agreed standards have been met prior to the occupation of these premises.
Reason
To ensure the proposal complies with policy 3.4 (Energy Efficiency) of the Southwark Plan 2007.

43) Notwithstanding the plans hereby approved, the school visitor parking indicated on plans PL 001 Revision D; PL 004 Revision D; PL 011 Revision G; PL 012 Revision H; PL 013 Revision H; and PL 014 Revision H, shall not be implemented other than in accordance with the Traffic Management Plan referred to in Condition 44.
Reason
In order for the Council to be satisfied with the details of traffic flows within the development and the parking arrangements in accordance with policies 5.6 and 5.7 of the Southwark Plan 2007.

44) Notwithstanding the plans hereby approved, the development shall not commence until details of a Traffic Management Plan has been submitted to and approved in writing by the Local Planning Authority. The Traffic Management Plan will outline measures to be adopted to restrict non residential traffic (including access to the school) from accessing the development, identify measures to allow emergency service access and outline the parking management strategy, including details of how the Health Centre and Community Centre parking bays will be allocated and managed to avoid congestion and illegal parking within the development site. The Traffic Management Plan shall then be implemented as approved.
Reason
In order for the Council to be satisfied with the measures to restrict school drop-off traffic gaining access to the site, the details of the parking arrangements throughout the development and other traffic related matters are in accordance with policies 5.2, 5.6 and 5.7 of the Southwark Plan 2007.
